ASSUMPTION OF RISK

Participation in the event and activities held on Saturday, September 12, 2026 (the “Event”), managed by, for, or on behalf of Fallbrook Land Conservancy (hereinafter “Organizer”) carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, but the risks range from 1) minor injuries such as scratches, bruises, and sprains, 2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions, 3) catastrophic injuries including paralysis and death.

In consideration of being allowed to participate in the Event, the undersigned acknowledges, appreciates, and agrees that:

1. The risk of injury from the activities involved in this Event is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

2. I have read the previous paragraphs, and I know, understand, and appreciate these and other risks that are inherent in Event. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation in the Event; and,

4. I willingly agree to comply with the stated and customary terms and conditions for participation in the Event. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest Event official immediately.

RELEASE OF LIABILITY

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, in consideration of being permitted to participate in any way in the Event, HEREBY RELEASE, DISCHARGE, HOLD HARMLESS AND COVENANT NOT TO SUE Fallbrook Land Conservancy, its successors and assigns, its owners, officers, directors, executives, consultants, professional advisors, officials, agents, employees and subcontractors, as well as the owners, lessors and lessees of the property, facilities and equipment used in connection with the event, the respective organizers, directors, officers, employees and agents of all of them, the other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the Event (collectively “Releasees”), for any and all claims, including negligence, resulting from ANY AND ALL INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

MEDICAL TREATMENT AND SAFETY ACKNOWLEDGMENT

In connection with any injury I may sustain or illness or other medical conditions I may experience during my participation in or attendance at the Event, I authorize any emergency first aid, medication, medical treatment or surgery deemed necessary by the attending medical personnel if I am not able to act on my own behalf. I further authorize the attending medical personnel to execute on my behalf any permission forms, consents or other appropriate documents relating to medical attention and to act on my behalf if I am not able or immediately available to do so. I acknowledge and agree to not enter the Event site if I have a fever, am experiencing any cold or flu symptoms or have knowingly been exposed to a communicable illness.

INDEMNIFICATION AND HOLD HARMLESS

I also agree to INDEMNIFY AND HOLD the Organizer and Releasees HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees brought as a result of my involvement in Event and to reimburse them for any such expenses incurred.

WEATHER AND EVENT CHANGES

I understand that the event may be modified, delayed, postponed, or canceled due to weather, fire danger, trail conditions, or other safety concerns.

Registration fees and donations are subject to the event's published cancellation policy.

PHOTO AND MEDIA RELEASE

I grant permission to the Fallbrook Land Conservancy to photograph, video record, or otherwise capture my participation during the event.

I authorize the use of these images or recordings for educational, promotional, fundraising, social media, website, and other nonprofit purposes without compensation.

Severability of Provisions

I agree that the foregoing agreements are intended to be as broad and inclusive as is permitted by law. Any provisions herein found by a court to be void or unenforceable shall not affect the validity or enforceability of any other provisions.

I HAVE READ THIS ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THE AGREEMENT FREELY AND VOLUNTARILY, AND INTEND BY MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
